These Terms & Conditions (“Terms”) govern your access to and use of the Pantry Commons website and
services (the “Service”), including our SMS text-messaging program. By using the Service, you agree to these
Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. The Service
Pantry Commons provides an online platform that helps people register with, communicate with, receive services from, and volunteer at a food pantry — including registration, phone verification, appointments, ordering, volunteer sign-up and scheduling, and related notifications.
2. SMS / Text Messaging Program Terms
Consent to receive messages
By providing your mobile phone number and opting in, you consent to receive recurring automated
text messages from Pantry Commons at the number you provide. Consent to receive text messages is not a
condition of receiving pantry services, of volunteering, or of any purchase.
- Program description. There are two separate opt-ins, and each one is its own checkbox:
- If you are a guest of a pantry: messages may include one-time verification passcodes, appointment and pickup reminders, order status updates, and occasional service announcements.
- If you sign up to volunteer: messages are about volunteer shifts — shift reminders, schedule changes, and requests to fill open shifts.
Opting in to one does not opt you in to the other. Every pantry that uses Pantry Commons texts you from the same number, so replying STOP stops texts from all of them, not only the pantry that texted you. Replying STOP also stops all of our text messages to your number regardless of program, because carriers apply it to the number rather than to one program; if you want to stop only volunteer shift texts and keep the rest, use the setting on your pantry’s volunteer page.
- Message frequency. Message frequency varies.
- Cost. Message and data rates may apply, according to your mobile carrier plan.
- Opt out. You can cancel at any time by replying STOP to any message. After you send STOP, we will send a confirmation message and you will not receive further messages of any kind, from any pantry that uses Pantry Commons, unless you opt in again. If you later reply START, we restore only the programs you had actually opted in to before — it does not sign you up for anything new.
- Help. For help, reply HELP to any message, or contact us at paul.augros@gmail.com.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed.
- Privacy. Your information is handled as described in our Privacy Policy. We do not share mobile opt-in information or consent with third parties or affiliates for marketing or promotional purposes.
3. Eligibility and Accounts
You agree to provide accurate and current information and to keep your account credentials, including access to your mobile number, secure. You are responsible for activity that occurs under your account.
4. Acceptable Use
You agree not to misuse the Service, including by attempting to access it in an unauthorized way, interfering with its operation, or using it for any unlawful purpose.
Prohibited activities
You may not use the Service, including any donation, ordering, storefront, fundraising or payment feature, to offer, sell, accept payment for, or promote any of the following:
- anything that violates any law, statute, ordinance or regulation;
- narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, or drug paraphernalia;
- cigarettes, other tobacco products, or e-cigarettes;
- alcoholic beverages;
- prescription drugs, medical devices, or health-care services;
- items that encourage, promote, facilitate or instruct others to engage in illegal activity;
- stolen goods, including digital and virtual goods;
- the promotion of hate, violence, racial or other forms of intolerance that is discriminatory, or the financial exploitation of a crime;
- items that are obscene, or sexually oriented materials or services;
- items that infringe or violate any copyright, trademark, right of publicity or privacy, or any other proprietary right;
- ammunition, firearms, firearm parts or accessories, or weapons or knives regulated under applicable law;
- gambling, lotteries, raffles, sweepstakes, prize draws, or any other activity with an entry fee and a prize;
- transactions that show the personal information of third parties in violation of applicable law;
- pyramid or Ponzi schemes, matrix programs, “get rich quick” schemes, or multi-level marketing programs;
- money transmission, currency exchange, check cashing, traveler’s checks, money orders, stored-value cards, escrow, or collecting payments on behalf of others;
- credit repair, debt settlement, lending or other credit transactions, insurance, annuities, or investments;
- cryptocurrency or other digital currencies;
- payments for the purpose of bribery or corruption;
- the sale of any item before the seller has control or possession of it; or
- products or services identified by government agencies as having a high likelihood of being fraudulent.
Organizations that accept donations or payments
An organization that accepts donations or payments through the Service does so through a third-party payment provider, such as PayPal or Stripe, under its own account with that provider. The organization is responsible for complying with that provider’s terms and policies — including the PayPal Acceptable Use Policy and Stripe’s restricted businesses list — and for obtaining any approval the provider requires before it accepts payments. PayPal, for example, requires its approval before an organization collects donations as a charity or non-profit. Pantry Commons may suspend or remove payment and donation features for any organization that violates this section.
5. Intellectual Property
The Service, including its content and software, is owned by or licensed to Pantry Commons and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.
6. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
7. Limitation of Liability
To the fullest extent permitted by law, Pantry Commons will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising from your use of the Service.
8. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms at this URL. Your continued use of the Service after an update means you accept the revised Terms.
